Claim 4618:125. ? .Mr Staifca foivplainfciff : and Mr .Hjaslett for defendant., ; "This case was partially heard .at last Court day, and was adjournedfor the production of books. ;; The ; plaintiff's .case rested on the fact that defendant, as manager for his father, had;, promised to see him paid for certain work done at the saw-mill, and‘that he would not have done the work unless defendant was personally responsible. The defence was that defendant had, only acted on behalf of his father' after consulting him, and that the plaintiff had acknowledged the responsibility of defendant's .father by rendering the account to him. Plaintiff was'nonsuiteii^without:costs,a .:; .ii'hh ;I) : Davidson v., Havelock Town Board—| Claimed 2s. ' This case was likewise, adjourned from last Court day for the: same reason—namely, for-the’ prodiidtion of books. Mr R. Jones produced' a receipt in full for all claims on the Board on the work done at the wharf by plaintiff, but the Board had acknowledged a further liability by paying 8s into Court.. After some evidence had been taken the case' was again adjourned to allow of the appearance of the Chairman of the Board; and in adjourning ,the case his. Worship com : mented on the fact that a claim for such a small amount should have been brought into Court, when, it might have .been settled in a satisfactory manner without, as by doing so the costs would amount to a great deal more than the claim.. ; ; - Peter McAlpine v. W. Gillespie-r----claim £l7 for wages. . This claim was denied,.as flip, defendant was, in partnership, and,‘the plaintiff; Svas, only entitled 'to a 1 partidipationin thd profits of the work of a . certain contract.
