Parnell <0 Boylan v. E. Burch. Claim £lO4 2s. sd. Mr. Brassey for the plaintiffs, Mr. Whitcombe for the defendants.

Mr. Whitcombe objected to the case being heard by 'he Resident Magistrate, as it was over £lOO.

A long argument ensued, the plaintiffs having abandoned the balance of £4 2s. 5d., Mr. Whitcombe argued that a specific item must be abandoned, and non merely a balance found to be due after an inquiry. His Worship decided to hear the case, taking a note of Mr. Whitcombe’s objection. H. C. Boylan, one of the plaintiffs gave evidence t.iat Burch had never disputed the account.

By Mr. Whitcombe—Did not know if there had been a balance in 1878, the time which the present claim dated from. Mr. Whitcombe asxed for an adjournment in order that the firm’s books might be produced, so that the whole accounts might be gone into. His Worship did not see how he could grant the request. The books were ultimately brought down by several porters. Witness continued—There was an arrangement with Burch as to the sale of powder and shot. Judgment for £96 3s. 5d., and costs £5 3s. Allan McLean v. Thomas U'Rcn. Claim £6. Judgment for plaintiff, and costs £2 3s. No order made for possession. Colbrook v. Brown. Claim £ll 6s. 9d. Judgment for plaintiff and costs £2.
