(Before J. Booth, Esq., R.M.) THIS DAY. Porter and Croft v. F. C. Bolton. Claim 19s. 6d. Mr. Ward for plaintiff; no appearance of defendant. Judgment for amount and costs, 12s. Nicholas & Co. v. Forrestier. Claim £lO 12s. Mr. Ward for plaintiff. Defendant disputed several items in the account, and pleaded that he had paid most of the balance. Judgment for amount claimed less 10s. 2d. Costs, £2 Ils. A. IF. Croft v. G. Burgess. Mr. Ward for plaintiff (trustee in the estate of C. D. Berry), Mr. Finn for defendant. The case was adjourned from last week for the production of further evidence. W. H. Clayton produced the books of the estate. Mr. Finn objected to the evidence, as the entries were not made by witness. Witness continued—The item for carting, £2 55., was in his handwriting. By Mr. Finn—Did not see the goods leave the place. He had heard it from the carter. George Burgess, defendant—Received £l5 from Berry for carting he had done on behalf of the Oil Spring Company. Knew nothing about any carting by Berry to Karaka on his (witness) account. Never asked him to cart any goods. Berry, when manager for the Oil Spring Company, usually paid by cheques Was in the habit of giving receipts for money. The carting was done by Berry’s order. He supposed for the South Pacific Oil Company. He might have taken up oats previously. Receipt (produced) for carting in August and September was for a separate transaction. By Mr. Finn—Was doing a lot of carting for the Oil Spring Company about the time for which the claim is made. Never borrowed any money from Berry. After hearing the evidence of Mr. D. Isles the case was further adjourned in order to procure the evidence of Mr. C. D. Berry and his clerk Mr. Russell. Sperry v. Dufaur d; Co. An application for rehearing of the case Property Tax Commissioner r. Dufaur Co. was granted.
