R. M. COURT, GISBORNE.
(Before J. Booth, Esq., R.M.) THIS DAY. Goldsmith v. Bloomfield & Wyllie. Claim £42 for clearing land, and cutting and splitting battens and strainers. Mr. McDougall for the plaintiff. Mr. Nolan, for the defendant Wyllie, confessed judgment. The defendant Bloomfield, was undefended. The plaintiff gave evidence to prove that he had been engaged by the defendants, by contract, to do the work. Judgment was given for the plaintiff, with costs £5 6s. Adaie v. Joses. Claim £4l Is. 9d. for goods supplied. Mr. Finn for plaint'ff, and Mr. Nolan for the defendant. Mr. Nolan explained that this was a claim against the executrix in the estate of James Jones, and submitted that the estate had not been administered, that there was no money in the estate io pay tae 20s. in the £, therefore the plaintiff would have to take a judgement against any future assets the estate might acquire. After hearing the argument of Mr. Finn, and also the plaintiff, His Worship granted a judgment for the plaintiff against the defendent as administratrix in the estate of James Jones. Costs of Court, £4 10s. Ledger v. Boland. Claim £ll 17s. Mr. McDougall for the plaintiff, and Mr. Finn for the defendant. Mr. Finn applied for a nonsuit on the ground that the particulars were not fu 1 ! and explicit ns was required by the Resident Magistrate’s Act.
