RESIDENT MAGISTRATE’S COURT.—GISBORNE.
(Before J. Booth, Esq., R.M,) WEDNESDAY. Assault. Frank Paulin was brought up before Mr. Bjoth, R.M., charged with the above offence. Mr. Rees appeared for the defendant, and Sergeant Bullen watched the case on the part of the police. Robert Hamilton, who appeared *n the box with his face badly disfigured, stattu that he knew the defer \i t. On Christmas night he came into town, and returned between 11 and 12 o’clock. On passing the cordial factory he heard eome one calling out, and found the defendant sitting down, and who said his horse had thrown him and badly sprained his ankle. Witness got off his horse and let the defendant get on. On arriving at Read’s gate the defendant got off and beat the complainant severely, as shown by the marks on his face. The defendant was quite sober. Dlr. Adams, who resides at Read’s gate, heard some men talking as he went home. On going indoors he heard a cry for help, and went out, but found the row over. He heard some one say “ I will make you pay for this.” He could not say who the men were. Sergeant Bullen expressed his disappointment at the way in which Mr. Adams had given his evidence. He had understood that the witness could identify the prisoner. He would ask for a further adjournment, in order to produce a witness who would prove that the defendant had to wash the blood off his hands on the night of the assault. His Worship said he should like some further corroborative evidence, as it was desirable that the offender should be found out. No doubt a brutal assault had been committed. The case was adjourned until Saturday next at 10.30 a.m.
