There was no other person in the bar at the time, Mrs. Allanach passed him in the passage as he was going out. After going out for two or three minutes he went back again and opened the bar parlor door and saw the barmaid. Mrs. Allanach and two men were inside the bar parlor. He saw no liquor the second time. He did not say anything to Mrs. Allanach or the barmaid. He was certain of the time as he intended to go round to the hotel.— To the Sergeant: He had been instructed to see that the Act was carried out in all the houses.

Miss Juett : Was barmaid at Allanach’s and remembered the night in question. At two minutes to 11 o’clock she left the bar and went to the side parlor, and stayed in there five or ten minutes. She then left, and remembering she had left her apron, she went through the bar to get it. One of the gentlemen then asked her the time, and she put her hand on the shelf and said 10 minutes past 11. She saw the constable pass the bar door whilst looking at the clock. Her instructions were to leave the bar at 11 p.m. To the Sergeant; She received those instructions when she went to the house first. After 11 she could go to bed or up stairs. She was instructed not to go into the bar parlor after 11 p.m. There were no drinks served after 11. When she went to the bar parlor, two gentlemen were in the side parlor on the opposite side of the passage. There were two others in the bar parlor. She was positive she never took a bottle or glass in her hand after 11 p.m.—This was the whole case.

His Worship said the evidence was so conflicting that he would have to dismiss the information. He thoroughly believed in what Constable Farmer had stated, and also Miss Juett, but as the two were to conflicting he would be compelled to dismiss the case.
