NATIVE LAND COURT.

Yesteeday morning Mr Rees applied to the Court on behalf of Capt. W. H. Tucker and Allan McDonald, M.H.R., for the East Coast to have the case reopened and set down for rehearing on Wednesday. He stated that the judgment had taken his clients by sur prise, and they had not been afforded sufficient opportunity of being present | that a misconception had arisen about the deeds mentioned by Captain Tucker; that a number of statements made on the part of Katarina were incorrect, and could bo disproved by him (Rees) as he had seen money paid to her himself. The Court said that if this application had been made with a view to any alteration or reversion of the judgment already delivered he should not grant it. The Court had maturely considered the case and had given its opinion that the transaction was unfair and unjust to Katarina ; and that as far nt any misconception having arisen relative to the deed mentioned by Tucker there could be no misconception on oath, as he (Tucker) hud stated that the deed was actually in Ins possession. But no such died was ever in existence. With respect to MeD>maul he had been afforded every opportunity of attending the Court, but had not chosen to do so, and had gone out of the district, Neither had any attempt been made to fulfil the suggestions of the Court, having for their object the security of the annuity to Katarina. Therefore the Court u ould not consider any application for a reconsideration of the judgment. It was competent for Mr Rees to curry the case to any other tribunal he thought nt. A Jong argument then mtted|”and an ex* planation was entered into by Mr Tucker, who admitted that he had made a mistake, having confounded uhe deed with another one in connection with Matawhero B. The argument will bo resumed to-day. Judgment was given at 2 o’clock in the Whatahina Block, when Captain Porter and Nikora Porter were awarded five acres.
