At tho Magistrate's Court yelterday afternoon a case of some interest to cordial manufacturers Was decided. Mrs Elizabeth Cooper, who is carrying on the business of a cordial maker on Thorndon Qtlay, was charged with having sold seven bottles of lemonade, containing John Lewin Bacon's trade mark. The evidence of complainant, an torated water manufacturer, was to tho effect that ha had taken out a trade mark, composed of the litters •• J.L.8." in an oblong figure, and had notified to all cordial makers in the olty that he would take action against anyone found guilty of using his bottles. He had spoken to accused On the subject, and she appeared to think it worth her while to run the risk. Three witnesses swore to receiving bottlee of lemonade bearing Bacon’s trade mark and Cooper’s labels. For the deforce it wee contended that tho bottles had not been filled with the knowledge of defendant, A fine at 20s. and no costs, was imposed. An accident occurred on the tram last night As the 6 o'clock tram was proceeding along Ingestre street, a pin of the awingletree broke; and the two horses broke away, pulling the driver over the splash-board. Two residents of Stanning street, named John Taylor and Joseph Eckswood, attempted to arrest tho progress of the horses, but were knocked down, one of the horses falling on Taylor, who was badly injnred, and taken to the Hospital. He lies in a critical condition. w Ecksworth escaped with light bruises. NELSON. A serious accident happened to Captain Whitwell, of ths steamer Charles Edwards, yesterday. The steamer is undergoing repairs, and ho Is superintending the alterations. While the donkey engine and boiler were being removed, he proceeded to render assistance to the men. As the boiler was slipping, his clothes caught, and he wae un> j able to escape, being thrown against tho 1 bulwarks, aud sustained a compound frac ture of the right thigh. Two projections of the boiler also pierced the flesh of his thigh to a considerable depth. The litemorrhage was great as the bone wae being re set. AUCKLAND. Wm. Elder, a settler of Orakau, who is not quite right in his head, got hold of some verdigris and nitric aoid. which he swallowed. He died In greet agony. The loss at Lamb's and Nathan's fire il estimated at £5OOO. The building belonged to Mr J. Lamb. It was insured In the New Zealand for £2500; damages, £6OO. Lamb's stock was insured In the New Zealand for £3OO. It is all damaged. NAPIER. ■ A cottage situated in Chancer Road, belonging to C. Maloney, cab proprietor, Wae ’ destroyed by fire this morning Owing to the fierceness of the flames very little furniture wao saved. The fire brigade arrived too late to save the cottage, but they siloneeded in saving an adjoining house. Maloney has no idea as to tho origin of tbo fire. The building wae Insured for £lOO.
