RESIDENT MAGISTRATE’S COURT.—GISBORNE.
(Before W. H. Tucker and W. Common, Esq., J.P.'s. Saturday. Drunkenness. —H, Percival was brought np, charged with the above offence. The prisoner pleaded guilty, and was fined ss, in Default 24 hours’ imprisonment. Ponsford v. Hubble. — Judgment was given in the above case on Saturday. Their Worships thought that the complainant had used unnecessary violence in laying bands on Mr Hubble, without giving him sufficient time to leave the premises. Hubble had been invited there by the Chairman of the Public Works Committee, who had a perfect right to inspect the work, either personally or by agents. Mr Rees said that Mr Ponsford, being the contractor, was legally in possession of the premises, and had a right to remove the defendant. The Bench thought that Mr Ponsford had used unnecessary violence. Even granting that the complainant had a legal right to order the defendant off the premises, he had no right to lay violent hands upon him, even had he refused to leave. They could not see how to punish defendant. The case would therefore be dismissed.
