At the Resident Magistrate’s Court on Tuesday last in the case of Rkkh, Wi Pure and Riperata Kahutia v. Gannon, Mr Rees, who appeared as plaintiff, counsel and witness claimed expenses on account of the numerous adjournments which had been granted. The court;was disinclined to allow the same, and Mr M’Dougall, who appeared for the defendant, said he was bound ro protect his client against such a claim, and protested strongly agamsl Mr Rees, under colour—“ ho would not use a stronger term ” —of calling himself a witness, making this demand and acting diametrically contrary to the law, which directed that, a trustee should not. derive any profit from his trust. Now we cannot help saying that, if this was really and virtually the case, we should seldom see the name of a certain gentleman, which is now so frequently paraded as a philantdrophical trustee, figuring as such. Mr Rees himself pleaded the fact of his being a trustee as an argument in support of his demand, but the astute Mr M’DoUGAL by his superior knowledge and acumen deftly turned the weapon against his adversary, thereby vanquishing him. W« cannot too highly commend the action of our Resident Magistrate in at all times disallowing all but fair, just and equitable expenses, as it is evident that by so doing he most materially furthers the ends and coufse of justice.
