RESIDENT MAGISTRATE’S COURT.—GISBORNE.
Yesterday. [Before J. W. Sunderland and C. Westrupp, Esqs., J.P.’s, j ADAIR V. L. DIERY. Mr Kenny appeared for the defendant; the plaintiff had no counsel. The plaintiff sought to claim £5 9s. 9d,, for goods supplied, £2 9s. 9d. being paid into Court. The defendant disputed the balance, viz., 605., for a case of gin. The plaintiff stated that Diery had come to him, and asked him to send a case of gin to Mr Johnstone’s, which he did ; at the same time he told him he would not charge it to Johnstone, but to himself (Diery), and that Diery agreed to it. The defendant stated to the contrary ; that he had ordered the gin, and had also given oiders for it to be charged to Johnstone. He had received the account for it, and had told Adair on several-occasions that he would not pay for it. After hearing Mr Kenny, a verdict was given for the plaintiff for the full amount claimed. Mr Kenny gave notice of appeal.
