This Day. [Before M. Price, Esq., R.M.] DBLIRIUM TREMENS. William Thomson should have appeared, but as he was in a very bad state through drinking heavily, the case was adjourned until Saturday next. A HORSE! A HORSE! Thomas Fitzgerald, who appeared on remand, charged with larceny as a bailee of a black mare owned by Henry McGreavy of Waipawa. The accused was remanded to the R.M. Court, Waipawa, to appear in eight days. Larceny. Hemi Tutaka was charged with having stolen three or four shillings from the person of Charles King. Charles King deposed : lam a saddler. I do not know the prisoner. I had too much to drink, and I do not remember the circumstances. I was in the bar parlor of the Masonic Hotel on Monday evening. I can’t say if prisoner was there, as I was slightly intoxicated. I did not give anyone authority to take money from me on that night. I had some money. I lost some, but could not say if prisoner had taken it. I usually keep my money in my left hand trousers pocket. I had no money when I got back to Mr Joyce’s Hotel. This was about halfpast in the evening. George Maher gave evidence to the effect that he saw the Maori with his hand in King’s pocket, and afterwards bring it out with some silver, which he showed to King. Wm. Miller, jun., and Constable Farmer also gave evidence. Mr Rees addressed the Court at some length, and pointed out the fact that after the alleged stealing the money was shown to King. His Worship said he would discharge the accused as the animus Jurandi had not been proved.
