TRUST COMMISSIONER'S COURT.
Tins Day. (Before M. Price, Esq., Trust Commissioner.) Gannon v. Rees, Wi Pere and Riperata Kahutia.—Messrs Brassey and Robinson appeared for the objec*Drs ; Mr Rees appeared for himself and co-trustees. This case, as our readers are aware, has been before the Court about nine different occasions during the past two months. Messrs Rees, Wi Pere, and Riperata Kahutia, who are selling their interest in the Whataupoko Block, 12,400 acres, to the New Zealand Land and Settlement Company, apply for a certificate. The application is opposed by Mr and Mrs Gannon on joint and separate grounds. The grounds generally are thg,t Mr Rees and his co-trustees are selling a portion of the block already conveyed to M. J. Gannon, also a portion (500 acres) covenanted to be conveyed. Deeds duly executed were produced before the Commissioner in support of the objections made, one of the deeds stipulating that any act or deed of Mr W. L. Rees with respect to a certain five hundred acres of Whataupoko would be invalid and ineffectual without the written consent of Mr and Mrs Gannon. The deed of sale to the Company was produced, and altered so as to exclude the portion already sold to Mr Gannon.
The Commissioner stated that many of the objections raised were beyond his jurisdiction, and could be only dealt with in a higher Court, but since the production of the deed of covenant duly stamped and registered from Rees to Gannon, and also the certified copy of the deed from Rees to Wi Pere and Riperata, he thought that the objection raised with regard to the 500 acres was a very strong one. After argument by the learned counsel on both sides, the Commissioner decided to give judgment on Monday next.
