Poverty Bay Standard. Published Every Evening. GISBORNE: FRIDAY, SEPTEMBER 29, 1882.
The Committee appointed at the meeting of the Cook County Council last night to confer with the deputation from the Borough Council, met this morning shortly after 10 o’clock, in the County Council Chambers. There were present — Crs. J. W. Johnson (in the chair), Westrup, Gannon, Ferris, and Chambers. The Borough Council was represented by His Worship the Mayor C. D. Bennett, Esq., and Cr. Clarke. The representatives of the respective local Ixxlies had full powers to enter into arrangements binding on both Councils. The object of the meeting was to settle the disputes, or rather difficulties that ha<l arisen with respect to the well-known Oxenham contract for the supply of metal to the Borough and"(’onnty. The agreement entered into between the County and the Borough terminate* to-mmixiw, 30th Sent. The Borough ( ouncil while accepting morally the obligations set forth in that agreement, hesitated apparently to incur any legal responsibility in the matter by refusing, as they did, to sign the said agreement that had already been signed by the County Council. Evidently a dead lock was imminent between the two local bodies which might have proved disastrous in preventing the supply of metal being continued, and consequently giving a poor prospect of passable roads in the winter. A brisk discussion took place, and on the motion ofCr. Gannon, a resolution to the following effect was unanimously resolved upon “ While the wiitractor is supplying
metal for the County that the County Council be responsible for aH risks at law in consequence of accidents from the tramway, and that the County receive the penalty of £2 per diem for overtime from the contractor. The Borough Council to be responsible in a corresponding manner for all accidents and actions at law in consequence of the same, • while the Borough is being supplied with • metal, and <luring such period receive the | penalty from the contractor while he is carrying out the portion of his contract with . the Borough. That an extension of time to j the 31st January, 1883, be granted by the I County Council to the Borough to complete ’ the contract, and that the terms of these i resolutions are understood to be based ; upon the terms of agreement arrived at, but incompletrd, in June last, between the I Borough Council and the County Council.” | A memorandum embodying the foregoing i resolution was committed to writing, and ; signed by the Chairman of the County , Council and His Worship the Mayor. ' The incompleted agreement was then j completed and signed, His Worship the j Mayor affixing his signature thereto. I We congratulate the two local bodies upon : their intelliaent solution of a difficulty that 1 might otherwise have resulted in a lengthy I disputation highly injurious to the best ini terests of the Bay.
