LICENSING COURT, GISBORNE.

TUESDAY, December 6th, 1881. (Before Messrs. Poyntbb, Sunderland, and Reynolds.) TERRY HOTEL, TOLOGA BAY. Mr. Robinson for the applicant. It appears that in this ease Mr Trimmer applies for a resumption of the license, which he allowed to lapse some time since, owing to business engagements. The police report was against the application, on the ground that there were two hotels already on the other side of the river.

On condition of there being two good paddocks attached to the hotel, the Court granted the application, but the fee was retained at the rate of £lO per annum. WHATATUTU HOTEL, MANGATU. Moseley Smith applied for a license being granted to this house. Sergeant Bullen reported against its necessity, and “ respectfully objects ” that the license be not granted. Mr. Nolan, for the applicant, urged that the license should be granted, provided that the building is completed by the end of the present month. Granted, on condition that the building is completed by the time stated, and provided that the police report is favorable thereon. Fee, £lO per annum.

The police report that in consideration of Mrs. Pickersgill not being allowed to remain in the house, they offer no objection to the transfer of the license to Robert Featherston. Mr Nolan appeared for the applicant. Application granted. ROSELAND HOTEL. The police reported that the proprietor, G. White, has allowed the conduct of the house to fall off very much ; and allowing a Mr Saddler, whose wife made a complaint to that effect, to remain in the hotel all day on Sunday, the 6th November, and supplied him with drink when drunk. There was also another complaint from Mrs Bell to a like effect; and the police stated that a man named Turnbull had lost his employment through staying drinking in the hotel for two days. Mr Nolan appeared for the licensee, and asked that the case be adjourned for one month. Adjourned accordingly to the 30th December. ARGYLL HOTEL, T. J. DICKSON. A complaint was lodged against this hotel to the effect that on the 21st November two disorderly Maori women were allowed to remain therein. They were creating a disturbance, and were being pulled about by three or four Europeans ; no effort being made to eject them ; the barman was in charge, and the landlord could not be seen, although asked for. Mr Finn appeared for the licensee, and said he did not know why the police should have made such a report, and read from the Act that the only duty of the police was to periodically report, but no provision was made for the Commissioner to act upon it, until an application for a new license is made. The Commissioners pointed out Section 40 of the Provincial Ordinance, which was against Mr Finn, who then pled the landlord’s absence, and the general good conduct of the hotel.

The Clerk of the Court informed the Court that the licensee had been previously warned by the Licen sing Bench. The Bench would not determine the license on this occasion, but on reference to the previous report in June last, it was the duty of the Bench to caution Mr Dickson as to the future conduct of his hotel. SEA VIEW HOTEL, TOLOGA BAY. The only report in this case was that a charge of larceny had been preferred against the landlord, M. Mullooly, and had been dismissed by the District Court Judge. Still the police thought that the fact ought to be brought before the notice of the Licensing Commissioners, as the evidence before the District Court disclosed very improper conduct. Mr Finn appeared for the licensee, and absolutely denied the necessity for the report. He went into the particulars of the case before the District Court ; and alluded to the averment of the jury that Mr Mullooly left the Court without a stain upon his character. The Court was of opinion that it does not come within the province of the Commissioners to take the circumstance into consideration, but thought that the police should have added the result of the prosecution to their report.

TOLOGA BAY HOTEL. Sergeant Bullen reports that the licensee, Henry Cannon, when questioned by the police about a certain stolen cheque, said he knew' nothing abont it, although it was traced to his possession. By this conduct an offender had escaped justice, and the police thought the Commissioners should know of the matter. The Court was satisfied that it did not think it was a proper question fot it to decide ; and Mr Cannon, in reply, said that the cheque was not traced to his charge. But the Commissioners thought that the expression in the report that, in consequence of Mr Cannon’s conduct, “an offender had escaped justice,” was somewhat too severe, and they did not deem it necessary to make a note against the license.
