RESIDENT MAGISTRATE’S COURT, GISBORNE.

Tuesday, November 15th, 1881. [Before J. H. Fisher, and W. Common, Esqs., J.P.’s] Wm. Richardson was fined ss, and costs 2s, for being drunk and disorderly, or in default 24 hours’ imprisonment. H. E. Webb v. W. L. Rees. Claim £B9 2s lOd for printing and advertising. Adjourned for one week. Mr. Brassey, who appeared for the plaintiff in this case, concurred in the adjournment, but he took occasion to say that owing to the unfortunate illness of Mr. Price, the business of the Court was being greatly impeded, and suggested that the Justices now on the Bench represent to the Government the desirableness of sending an R.M. to fill Mr. Price’s place during hie illness. The Bench coincided with this view, and said effect should be given to the worthy Counsel’s suggestions. E. Gruner v. J. Bidgood. Alleged rescue of goods in tiie possession of the Bailiff. Mr. Brassey for the defendant pleaded not guilty. E. Gruner sworn deposed to being bailiff of the Court. On the 10th he sent Banks, one of his assistants to Ormond to make a levy on Bidgood’s property. J. Banks on oath deposed to going to Bidgood’s place to execute a warrant of the Court. Defendant said he was to clear out, and was verv excited. Bidgood said there was nothing there for me, and would sling me out if I did not go. Witness did not go out, and shortly after Bidgood did sling him out. Witness fell down, and Bidgood ran him out into the road. He said the things were all covered by a Bill of Sale. That was the substance of what occurred. By Mr. Brassey : I did not show him the warrant. Bidgood gave me no time. I went with Bidgood afterwards, and had a glass of beer with him. By the Bench : I told him my errand, and I supposed he knew I had the warrant, as I had read it to Mrs. Bidgood. I took an inventory of some of the goods. In explanation to the Bench Mr. Brassey said it was quite sufficient if he read the warrant to Mrs. Bidgood. Mr. Brassey contended that |no rescue had been made, as the goods were not in the .Bailiff’s possession. Case dismissed.
