• Friday, August 12th, 1881. [Before M. Price, Esq., R.M.] A Native named Hirini was fined 5s for being drunk. Thomas Warner was charged on the information of D. McKay with having obtained money under false pretences, and remanded to Wednesday next, the 17th inst., in order for the appearance of a principal witness. . Bromley v. Panapa. < Mr. Robinson appeared for the plaintiff. Adjourned for a fortnight. P.B. Highway Board v. D. Cameron Adjourned to Friday the 26th instant. E. P. Joyce v. Gt. K. Turton. Judgment summons for the recovery of £9 Ils. G-. K. Turton sworn was examined by the plaintiff, who deposed to having 1 given him a cheque for £8 15s, but it was not honored. He had funds at the bank at the time, but not sufficient. He represented to the plaintiff that the cheque would be met.

By the Court: The cheque was given partly for cash, and partly other things The cash was received some time before. He was unable to pay the amount. He had told plaintiff that if he held the cheque over he would pay it. He had had several cases at Tologa Bay, but had not received his fees. Mr. Matthews, Manager of the Bank of New Zealand deposed to the presentation of the cheque, that there were funds to Mr. Turton’s credit at the bank up to the day before the presentation of the cheque. His Worship remarked on the circumstances under which the cheque was given. He thought the plaintiff had a fair portion of the professional work of the place, and should make an effort to pay the debt. His Worship was about to make an order, for payment by instalments, when the defendant said he could pay the amount in a fortnight, and an order was made for payment in full by Tuesday next the 16th instant.
