RESIDENT MAGISTRATE’S COURT.
Gisborne, Tuesday, November 16,1875. Before W. K. Nesbitt, Esq., R.M. Thelwall v. Kelly. Claim, £5 6s. £2 6s was paid into Court, as admitted, the balance of £3 was disputed. Mr. Rogan for plaintiff. Robert Thelwall deposed that it was for grazing and damage clone to fence. Defendant complained that the charge was made for depasturing some cattle and that any damage done could not be claimed. There were other cattle in the paddock. B. Sheriff sworn, proved the damage done to the fence as being about 50s, and the bench gave judgment for £2 2s, and costs. ... M. Mullooly v. J. Trimmer. Claim, £2B 18s 4d, disputed account. Mr. Rogan for defendent, pleaded not indebted. Plaintiff on being sworn deposed to the pa rtioulars of claim ; but did not recoj .ee whether hehadmadeademand upon defen-
dant for the amount prior to ordering the summons to issue. Defendant sent him a cheque, which he (plaintiff) refused to accept. Defendant sworn : The items in dispute might hare been supplied to my brother, but I know nothing of them. I tendered a cheque to defendant for amount of claim prior to receiving the summons, and was surprised to find plaintiff had refused it. Judgment for plaintiff for the amount of the cheque, £25, without costs.
