RESIDENT MAGISTRATE’S COURT
Gisborne, Tuesday, August 31,1875. Before W. K. Nesbitt, Esq., R.M. ARTHUR V. EIFFE. Claim, £5O, being amount alleged to have been paid by plaintiff to defendantin mistake. Adjourned to Tuesday, the 28th September. HOANI NGAPUHI V. WILSON. Claim, £5 damages for assault. Plaintiff, sworn, deposed to having been in the Argyll Hotel, on the Ist August. He enquired of defendant for Panapa, but was refused to be allowed to see him. Defendant shut the door, and he went in the front of the bar with another native. Defendant then came to them and told them to go away ; they were going out when defendant struck him (the plaintiff) on the head with a brass tap. Samuel Mason Wilson, landlord of the Argyll Hotel, was called for the defence, and deposed: The complainant endeavored to force his way into the bar parlour of my Hotel; it is a private room. He persisted, and broke the fastening of the door, upon which I threw him on to the verandah. He came round to the front of the bar, and made violent gesticulations, when, being much annoyed at the disturbance caused, I again threw him out of the door. He was not sober. This was corroborated by two
witnesses. The Bench considered there was no evidence to prove the assault, and dismissed the case. WILSON V. HOANI NGAPUHI. Claim, £5, damages sustained in consequence of defendant breaking the door of his Hotel, and trespass. Judgment for plaintiff for £1 and costs £3. WEBB V. 0. GOLDSMITH. .Judgment summons. Claim,£lo 8s 9d. Plaintiff said that an arrangement had been made by which defendant was to pay 10s a week, including interest. Judgment accordingly with costs. v
