Three natives named Era Eru, Hohepa Ngarangi, and Horomana were charged with assaulting and robbing on the highway, one Thomas Matthews. The complqirHint’s appearance gave ample testimony of having been severely treated, and, on being sworn, deposed to having been struck suddenly from behind while on the road from Ormond to Waerenga-a-bika on Tuesday night last. One of the prisoners struck me with a long rail. I said, Do not kill me.” A second blow felled me to the ground. One of the natives put his knee on my chest. The one on my right hand—the larger man of the two —took the money from my pocket, £4 in notes, a half sovereign, and some silver. They then left me. ; I endeavoured to rise, but could not, I heard one of the prisoners say “ Give him another crack,” but my dogs prevented them. I only recollect having seen two natives. Ido not remember seeing Eru Era. I cannot be mistaken as to Hohepa: I recognise him by his beard. Witness then detailed the particulars as to passing the nigh t at Mr. Breingan’s, and the subsequent information which led to the apprehension of the prisoners.

Sergeant Mills deposed to the apprehension of Hohepa, and said that the other two prisoners voluntarily gave themselves into custody. Mr W. W. Wilson here announced to the Court that he had been instructed to conduct the defence on behalf of two of the prisoners, and requested the recall of the prosecutor. The cross-examination went in the direction of showing that Matthews had been in the prisoners’ whare on the previous night after their women, which was denied, prosecutor stating that he had business there, but refused to state whatthe nature of the business was. ... The Beneh stayed the proceedings, and remanded the charge until yesterday, as the prosecutor was under the influence of liquor.
