STORES IN CONNECTION WITH HOTELS.
i : (From the’ Dunedin Guardian.) The adjourned application of James Baxter, for a license for the Maitland Hotel, was called on.
The Chairman..(Ml-. BathgateJß.M), said: by James Baxter,’td which an objection has been lodged that he has a store ih connection with his licensed premises? 1 The Court adjourned the consideration of this question until to-day, in order to have full time to consider the bearing of the arguments stated on Jjgkalf of the applicant, namely, that those parties who have stores; iq •connection wjth their hot-elk possess a.vested,. interest, that the intention of the Act was to preserve such interest, and that the prohibition extended only to new applications,• The. Rqnybgiven every consideration to that? argument Their minds are made up, as no doubt the minds of the public are made up, and they are of opinion that a store in connection with a public-house is very mischievous gi/ the interests of the -public. The spirit of the Act is, no doubt, against it, : whatever may be said in : rdgard to its being limited to new applications. It; is; our opinion that?every license under this Act should give his undivided attention to the proper carrying on of his business. It is not reaspiiablej to think if a man has two distinct businesses, he can do justice to the more important one, namely, the sale of alcoholic' drink. The Cburt is opposed to giving licenses to persons having stores in connection with their public-houses. It has discretion under the Act of 1873 to refuse any license; bpt )v)iilo having that power they do not wish to take these applii cants and intend to-day-Jq. grant the whole of these licenses so objected to, giving the parties concerned.. a > cautiqn that they ipust do the best they can' and make better arrangeiaents. before .the next, annual Licensing Court is held. They must sell their store business during the next twelve months, for at the end of that time the Bench will sustain an, objection of this kind if made. The license is therefore granted, but the applicant must use bis best endeavours to wind up his store business.
