PORT OF POVERTY BAY. ARRIVALS. FEBRUARY. 14 -Gem, schooner, Captain Watt, from Auckland, with 30,000 feel timber order of Captain Read. DEPARTURES. FEBRUARY. NiL The Jessie Read man cleared for London from Wellington, with about 4500 bales wool and other produce. The whole cargo is valued at £90,030.
The ship Rakaia arrived at Lyttelton from Plymouth, 81 days out, with 300 immigrants, and 10 saloon passengers. The ship has been placed in quarantine. During the voyage there were 11 deaths of children, 55 cases of measles, and eight of scarletina. The Sydney Empire states that the Imperial Government have given lI.MB. Pearl to the New Zealand Government for a training ship, and that she will be stationed at Wellington.
An Auckland Ship in Court. —Sir Redmond Barry, as Judge of the Vice-Admiralty Court, has given his decision in the suit relating to the barque Lady Franklyn. The vessel had belonged to Mr. Thorne, of Auckland, and was despatched on a voyage from Auckland to Melbourne, thence to Newcastle, N.8.W., there to await orders. After the vessel arrived in Melbourne, it was found necessary to expend large sums for necessaries, repairs, &c. Messrs- Lord and Son, the agents of the ship, advancer!, in Ihe first instance, £395, receiving a draft on the owner for the amount, which was subsequently paid. Afterwards they advanced further sums, making altugef her £lOOO, and for this the captain gave them a bottomry bond. Messrs. Lord and Son sought to enforce the bond, as Thorne had become insolvent. The validity of the bund was disputed by the Bank of New South Walet, who were mortgagees of the vessel, on the ground that the advances were really made on the personal credit of Thorne, and that the bond was an afterthought, to secure Messrs. Lord and Son, when it was found that the owner was becoming embarrassed. The Judge decided in favor of the bank, but without costs. —Melbourne Argus.
