R.M.'s COURT—GISBORNE.
Thursday, March 26, 1874. [Before W. K. Nesbitt, Esquire, R.M.] Daly v. Daly. Adjourned to Thursday 2nd April. Boylan v. Taylor—Judgment Summons. Claim £9 Ils lOd. Defendant examined on oath said : That he had incurred the debt on account of grass seed and that he had not yet been paid for it. He got the goods for other people who had not paid him. Mr. Mullooly owed him some money, but he was in Auckland. Defendant consented to give three weeks for payment. Judgment accordingly. Riperata Kahutia v. Mikaere Turangi AND OTHERS. Case dismissed. Riperata Kahutia v. Stevenson. Mr. Cuff for plaintiff; Mr. Wilson for defendant. Adjourned from last sitting day. W. H. Tucker, re-called, sworn, states: there are 64 panels of fencing pulled down. Stevenson admits to having pulled down 54 panels. There were 4 posts destroyed valued at Is each. I think it would cost Is a panel to re-erect the fence according to offers I have had made. For the defence. Rawiri Mackey, sworn, states : I was acting as interpreter for defendant relative to the pulling down of the fence. I heard Rota say to the defendant “ its all right,” but I did not hear plaintiff consent. By Mr. Cuff: I did not tell defendant that plaintiff had consented. 1 will undertake to re-erect the fence for £l. Judgment for £1 and costs.
