Thubsday, July 24. [Before W. K. Nesbitt, Esq., R.M.] Geobge Montgomery Vantbeight was •charged as a vagrant with having no visible means of support. —Discharged with a caution. Paoba Pebe v. Guben e.—Plaintiff sued to recover from defendant a dark bay mare, or £5, its value. The Bench considered that plaintiff had failed to establish his case and gave.judgment for defendant. Read v. Wi Mackey.—Plaintiff claimed to recover from defendant one bay filly, or £5, its value.—Judgment for £5, or the horse to‘be returned. Pbitchaed v. Buenand.—Mr. Cuff appeared for plaintiff. Claim of £5O damages for breach of agreement. It appeared that, according to plaintiff, an agreement had been entered into between the parties whereby the defendant, for certain considerations stated therein, agreed not to commence business as a carter in Gisborne, in opposition to plaintiff. Defendant admitted the breach of the agreement as made, but denied that he had agreed not to oppose plaintiff as a carter. He had broken the agreement as he had been doing business as a carter for about five months and a half. —Heber Pritchard, sworn, stated : — “ I am a carter in Gisborne. I earn on an average £2 a week clear of expenses. The defendant has been working under my price, and has occasioned me to put aside one of my drays.” —Judgment for £5 and costs. Te Paki and others v. Mubphy.—Mr. Cuff for plaintiffs. This was an adjourned case in which the plaintiffs claimed from the defendant the sum of £4O as being due on certain lands at Tologa Bay, rented by him from them. The case was adjourned for the production of the original lease, by defendant which, according to hie statement, contains a clause providing for the payment of 10 per cent, duty by the lessors. Defendant, at the adjourned hearing, failed to produce the lease, and the Bench gave judgment against him for £35 and costs. Mr. Murphy applied for a re-hearing of the case on the arrival of Mr. Locke, which was granted.
