Thursday, July 17. [Before W. K. Nesbitt, Esq., R.M.] Thomas v. Bidgood & Davis.—Debt £4lss 3d. Judgment by default. Thomas v. Bidgood.—Debt £3l7s 3d. Judgment by default. Tuckeb v. Clahk. —Claim £lO for damages. In this case plaintiff claimed from defendant the sum of £lO damages sustained by reason of the defendant having failed to perform a certain contract to build a chimney in the house of the plaintiff, which contract was entered into between the said parties, and reduced into writing, and delivered to the defendant, and is not in the custody or control of the plaintiff, W. H. Tucker deposed to the general tenor of the agreement, which was supported by several witnesses. Defendant stated “I did agree to build a chimney for plaintiff, but made no agreement as to time- I could not leave the job I was at. I did not refuse to do it. If I had commenced it, I could not finishit for want of material.” Judgment for plaintiff £2 and costs.
