The case, certainly, contained a great principle, but the fight which usually occurs between the two forensic gladiators when they do meet as opposing counsel destroys all attempts of the Bench to weigh with nicety those points which generally require a cooler reflection than could be obtained on Thursday. Dr. Nesbitt’s patience is commendable, but his want of firmness, injudicious. Judgment for plaintiff £5 and costs.
