ruptcy, [ debtor’s discharge had been agreed to, as the bankruptcy was through no fault of Mr Dixon’s. v The trustee’s report was favourable, and the order was granted. Re J, ARMSTRONG, 1 Application for an order to tax costs up to and before the appointment of trustee. Mr Hamerton appeared in support of the application. His Honor said that the application should; be supported by affidavit. ‘ Mr Hame.ton was not aware until Saturday that, an application would be necessary. An affidavit could be filed with the papers. Mr North, the trustee, objected to the order. It would entail £3 extra expense, and it seamed to him. unnecessary.., He thought the bill of costs was excessive, but he did not think he would get .three pounds taken off. Mr Hamerton said be was forced to come here. Mr North had promised to pay hut had not done so. He (counsel) had paid the trustee £2B belonging to the estate and he might have stuck to that .and paid the balance after deducting his account. 5 ' : <• said-he told Mr Hamerton’s brother that he would pay it but he had not time on Saturday, having to attend elsewhere at 11 o’clock when Mr Hamerton came. His Honor said that he would strike the word “ tax” out and make it that. Mr Hamerton applied lor an order for costs. Order made. \ u IN CHAMBERS. 1 Mr Hamerton applied for an injunction against Messrs Wilkie and ? Orawford, Railway Contractors, restraining them from depositing earth in the river. He J promised to file the affidavits tomorrow morning, and his Honor promisedAo consider the application.; • The Court then adjourned.
