STREETS IN PATEA EDUCATION RESERVES.
The Taranaki Education Reserves Commissioners were recently asked to form streets in the Education reserves leased by the Board at Patea. A legal opinion on this point obtained from Mr Richmond points out that section 211 of the Municipal Corporations Act distinctly contemplates that the Borough Council will not take over a private street and convert it into a public one unless first properly formed and constructed. He also considered the appropriation of money for road making out of the revenues of the Commissioners is outside the intention of the Education Act. But looking at the matter as a practical question, was of opinion, “if the outlay required is not large enough to embarrass the Commissioners and seriously diminish the amount available for the maintenance of schools, it is not likely that any question as to the legality of the expenditure will be raised.” Acting on this opinion the Commissioners resolved, “ That the Secretary be instructed to inquire from Mr Cowern as to the probable cost of making the streets through the Education reserves in Patea referred to in his letter of .the 4th July ; also, that the Secretary be instructed to write to the Minister for Education to acquaint him with the requirements of the Borough Council of Patea to open streets through some Education reserves lately leased to tenants in that Borough, and to request his advice thereon, and to forward the opinion of the Board’s solicitor.”
