Patea R.M. Court.

Tuesday, before Mr Wray, R.M. TIMBER WHARF CHARGES. Judgment was delivered to-day in the suit of the Harbor Board against Mr C. F Barker. The Board claimed £4 6s 8d for seven days’ use and occupation of foreshore near .timber wharf, he having stacked timber there after accepting formal delivery ; and claimed £4 Ss 4d for landing and storage.

The question was whether, in leaving timber on the foreshore, the Board were entitled to charge a special fee for use and occupation of the land in the absence of a contract, express or implied. The Board were entitled to recover according .to the storage value for the timber on the wharf, namely £4 3s 4d ; and in addition to this a sum of 5s would be sufficient for use and occupation of foreshore, on quantum meruit. Verdict accordingly. DEBT CASES. Taplin v, D Anderson was a claim which defendant had offered to settle, but the terms not being acceptable, an arrangement was come to in Court. Taplin v. Kennedy was a claim for £lO 1 Is. Defendant promising to pay, verdict was given for amount and costs. Taplin v. T. Parnell was a claim for £3 17s 6d. Defendant did not appear. Judgment for amount.and costs.
