g YE-LAWS OF THE PATEA HARBOR’ BOARD. In pursuance of the 57th and 215 th Sections of “The Harbors Act, 1878," the Patea Harbor Board, hereinafter called the Boaid, make the following Regulations, that is to say : 1. The term Wharfinger shall apply to such person or persons as tlie Board may from time to time appoint to take charge of the Wharves, and shall include his or their deputy or substitute. All dues, unless otherwise directed, shall be paid to the Wharfinger. 2. The exemptions confaincd in Schedule No. 5 shall apply to all the Wharves ami the foreshore vested in the Board, without exception. 8. The following Rules for® the management of the respective Wharves shall be observed : WHARF RULES. 1. Each Wharf shall be open for receipt and delivery of goods on all days except Sundays, Christmas Days, and Good Fridays. Vessels may load and discharge from 8 a.m. to 5 p.M. 2. The Wharfinger shall receive all goods landed at the ship’s side, and give a receipt foi the same, provided always that he need not give such receipt for twenty-four hours, unless, previous to the vessel commencing to discharge, he has been supplied by the Master of the vessel with a copy of the Manifest or Freight List, showing the weights and measurements on which freight is charged. 3. The Wharfinger shall receive all goods intended for shipment from the drays, and give receipts for ’ the same, and, if required, obtain the signature of the Mate or Purser to shipping notes. 4. All vessels lying at the Wharf shall have properly fixed gangways for reaching the Wharf, and shall, throughout the night, show a proper light ai the gangway, to the satisfaction of the Harbor Master. 5. The Wharfinger shall provide all labor on the Wharves (except at such Wharves as may be erected by, or with the consent of, the Board for special purposes), and for loading and unloading drays, beyond the assistance of the driver, and shall be responsible for all goods in his custody. <3. The Wharfinger shall have control of all carts and vehicles attending the Wharf, and shall admit such in their proper turn for loading or discharging. 7. If, in the judgment of the Wharfinger, the weather is threatening, lie is empowered to convey to store, or (if the same be full of goods) to deliver, within the precincts of the town of Carlyle, at cost of consignee, all goods landed. 8. If the Wharfinger, on application, neglect or refuse to give delivery of any cargo landed, to any consignee, or his authorised agent, by 5 p.m. on ordinary business days, any costs afterwards incurred to store such goods for their safe custody shall be borne by the Wharfinger. 9. Ballast and coal shall not be deposited on any Wharf ; and persons loading or discharging either, shall provide means to prevent any portion thereof falling into the water. 10. The Wharfinger shall enforce all Bye-Laws, Rules, and Regulations of the Board relating to the Wharves and foreshore under his control, and shall, at his own expense, institute and conduct all summary proceedings against any person or persona offending against the same. - 11. Masters of vessels and Shippers to supply the Wharfinger with a list of cargo to be shipped or landed, together with ■ the particulars of weight or measurement on which freight is calculated, and Wharfage to be paid accordingly, unless the measurement or weight be found incorrect, in which case the same is to be paid on the correct measurement or weight. 12. The Wharfinger need not take delivery, or be in any way responsible for goods, unless landed on the Wharves. Schedule No. 1. ■Wharf Charges, including Labor and Storage for Twenty-four Hours, the Time to be computed from 5 p.m. of the Day Schedule No. 2. Scale on which Wharf Charges shall be Calculated. Cases or Casks, Beer or Stout, containing 8 to the ton. Ift. Gin. each. 3 to the ton. 6 to the ton. 64ft. 6 to the ton. 20 to the ton. Ift. Sin. 20 skins. 20 to the ton. 12 to the ton. 10 to the ton. not over four dozen reputed quarts, as Cases of Spirits, Wines, &c., containing not over one dozen reputed quarts, at Hogsheads, Beer or Spirits, as Quarter-casks and Barrels 400-gallon Iron Tanks, when full as Casks Portland Cement, as ... Cases Kerosene (eight gallons each), as Drums Oil (five gallons each), as ... Sheepskins—a bundle shall mean ... Chaff and Bran, in three-bushel sacks Eye-grass and Cocksfoot Seed, three bushel sacks Contents all other three-bushel sacks Small packages, or packages landed from a • vessel for one Consignee, and measuring in the aggregate less than one-third of a ton, shall be charged for as One-third of a ton. Hay, Straw, Butter, Tallow, and Coke, to bo charged by weight. All other goods shall be charged at the weight or measurement on which freight is collected, unless such is found incorrect, in which case Wharfage is to be paid on the correct weight or measurement. All goods landed or shipped on the Foreshore shall be charged half Wharfage rate. No labor provided by Wharfinger. Schedule No. 3. Wharfage Charges payable by Masters or Owners of Vessels. Vessels discharging cargo shall be allowed one clear working day for every thirty tons register, and leisels loading, two days for every thirty tons register. After that time they shall pay 2d per ton per day. Vessels with only part cargo to be allowed time in proportion which their cargo bears to their registered tonnage. This is to be determined by the Harbor Master. Schedule No, 4. Wharfage and Charges on Transhipment Goods. Storage on all goods not taken delivery of within twenty-four hours, shall be charged at a single Wharfage rate for every week, or part of a week, such goods are stored. Except only as hereinafter provided in case of transhipment, goods for transhipment, and not removed from the Wharf, shall be entitled to seven days’ storage free, and such goods shall only pay a single Wharfage rate. Goods transhipped from one vessel to another alongside any Wharf, or within the Port, shall pay half the Wharfage that would be charged on. landing such goods.. Cartage to convey transhipment goods to store shall be charged at the rate of Is per ton. Schedule No, 5. Exemption from Does. Notwithstanding anything hereinbefore provided, no Wharfage shall bo charged on Ships’Stores supplied to vessels at the Wharf and carried by hand. Passengers’ luggage to the extent allowed by vessels, provided the same does not exceed half a ton measurement. But this clause does’not apply to commercial travellers’ sample packages. Settler and Maori produce or manufactures brought down the river, when landed on the Foreshore. Vessels or goods belonging to the Imperial or Colonial Government, but labor in connection with such need not be provided by the Wharfinger. , In witness whereof the Common.
