(Before C. A. Wray, Esq., R.M.). Thursday, August 1. Sergeant Whelan, acting on behalf of Government, sued F. Nickell for €29 13s, being arrears of rent due for one of Ihe Government immigration cottages. It appears that defendant had occupied for a considerable period one of the Government cottages. At the time he took possession, another person occupied the other portion of same cottage, but left almost immediately afterwards, leaving defendant sole occupant. Former collectors had been lax in regard to collection of rents, and until Sergeant Whelan was latel}" instructed to collect arrears, defendant concluded that he was not going to be called upon to pay, and in any case only expected to pay half the full rent. Judgment was given for the amount claimed and 25s costs, to be paid by instalments of 6s per week. In giving judgment, the R.M. advised that plaintiff should recommend the Government to remit one half of the claim, on the

ground that defendant occupied one half of the house only, and being a foreigner* was ignorant of'his liability for the whole. Sergeant Whelan v P. O’Neil.
