(Before C. A. Wray, Esq., IBM., and 11. F. Christie, Esq., J.P.) (Tuniisn.w, Jump 7, 1877 ) CiVII. CASUS. S. Tapiin v. Thomas Jenkins, judgment summons for £33 3s, relumed from the Supreme Court. Mr Adams appeared for tin; plain! iff: Samuel Tapi in deposed that defendant had been in a position to pay the amount of the drum shine judgment had been given, as ho was a, contractor, and had received a considerable sum of monev for works undertaken at the Sorry Mile Bush.—The Bench ordered the defendant to ho committed for two months. S. Tapiin v, G. Treweek ; chum. 8; Ids. .Adjourned lor a week. S. Taplin v. T. Jenkins ; claim, £0 Os ; judgment summons. The Bunch ordered defendant to be committed for 14 days. fd. Tapiin v. James Davidson (V\ henna, knra) ; claim. £Bl 13s. Paid into Conn. S. Tapiin v. Horn' Pihama ; claim, £34 7s t!d, for oats supplied. Mr Fitzhcrbert for plaintiff, anti Mr Ilamsrton for do!ondant. After counsel for both sides had .spoken, Mr ilamerton asked fur an adjournment for two months, to allow of important evidence being taken both at Wellington and New Plymouth. The Bench granted the adjournment, defendant to pay costs, amounting’ to £5 Ids 3d The witnesses present were ordered to attend the Court on the 2nd August next.
