RESIDENT MAGISTRATE’S COURT.
Monday, March 20. (Before Major Turner, and Dr Crofh J.P.’s) Obtaining Monky. —Felix McCarthy v. George Lynch. Claim, £o. Mr Adams appeared on behalf of plaintiff, and explained that his client had agreed to buy some land from the defendant, and paid a deposit of Hi) on the same to defendant. Shortly afterwards, plaintiff gave instructions to him (Mr Adams) to prepare the conveyance. On the same being forwarded to the Registry Office, it was discovered that defendant had not a title to the land he had agreed to sell. On finding this out, plaintiff asked for his deposit, and expenses incurred (£2 17s), which defendant objected to pay, hence proceedings were taken for the recovery of the same. The defendant, who appeared in Court, admitted to having agreed with Mr McCarthy to sell seme laud owned by him, and to having received a deposit of £5. He was willing to pay back the deposit, hut thought that he was not liable for the expenses. In reply to question put by the Bench, defendant said, I did not receive any title to the land in question from the person whom I bought it of. The Bench gave judgment for the amount claimed, with costs. Defendant asked fortune to pay, but the Bench refused, saying that if he could find money to gamble at races, &c., that he should find means to pay Iris debts. Furious Driving Sergeant Whelan charged Joseph Devonshire with furious driving and riding through the streets of Carlyle, on the 22nd March last, and deposed to seeing tiro defendant riding on horseback and driving two other horses through the streets at a furious rate, on the morning in question. He said it was a common practice for the grooms, employed at tire livery stables, to bring horses along in the manner described, which was a source of danger to footpassengers. The Bench lined defendant os and costs, and remarked that he should have had his horses brought in at an early hour, when the streets were clear of footpassengers.
