RESIDENT MAGISTRATE'S COURT.

SATURDAY, MARCH 17. (Before Captain Wray, JEW) Alleged Nuisance. —William Dale, jun.< was charged, on the information of the Inspector of Nuisances, with allowing a foul water closet on his premises, contrary to certain clauses of the Public Health Act. It appeared from the evidence taken, that the defendant was served with a notice to have certain nuisances on his premises abated—the water closet being amongst the nuisances complained of — that the Inspector had examined several alleged nuisances,- and feeling satisfied that the conditions of the Act had been complied with, reported accordingly to the Town Board (which is also the Local Board of Health.) It seemed,** however, that certain members of the Board considered that the nuisance was not sufficiently abated, particularly the closet, whereupon the Town Board passed a resolution that a fresh notice be served on the defendant to have the said closet emptied; and

failing to comply, proceedings to he instituted against him. Toe defend.-nt argued at great length that the closet in question was kept as clean and tree from foulness as closets in genei'a!. and that by regular use of lime, stench was avoided, which in fact was proved hy the Inspector of Nuisance’s evidence. The defendant, therefore, contended, that the case should 1)0 dismissed. The K.M., afterconsidciing the evidence, dismissed the information. Monday, .MAnni H>. (Before Captain Wkav, 11.M.) Stkallno,. —George Wright was charged, on the information of Samuel Dixon, hotelkeeper at Kakaramea, with breaking into his store on the 18th instant, and stealing (herefrom several articles, vained between To and TlO. The prisoner pleaded guilty. A great portion of the slolen properly found on prisoner was produced in Court. After evidence had been taken, the PAL remarked that as the prisoner had confessed to the charge, he would not commit him for trial, but would go to the full length of his jurisdiction, and sentence the prisoner to twelve calendar months imprisonment, with hard labour, in tho Taranaki gaol.
