Jessie Foley pj^tirioned for a riissolution o£ her marriage with Arthur Palmer Foley, on the ground of desertion.

Mr J. B. Callan. jun., who represented petitioner, said the parties were married on May 31, 1378, and lived together in Dunedin. There were four children of the marriage, all of whom were of age. The grounds of rh<» petition were based on desertion, which took place in 1895. 11l that year respondent left for New .South Wales with thp intenrion of finding work, and had not beon seen by his wife since, but she received two letters from him. In 1901 incfiuries were mate through the New South Wales police for respondent, but no trace of hun was found.

Eijdc-nce was given by petitioner and by Teresa Crosswdl (h»r sister), after which his Honor granted a decre3 nisi, to become absolute in three months.
