CLAIM FOR POSSESSION ORDER, . REFUSED - » _ At the ,monthly sitting of the Opotiki Magistrate’s Court, M. O. Kidd,. Ltd. (Mr. Hodgson); proceeded' against A. E. Wilcox (Mr. Bunkall>. claiming possession of premises occupied by the defendant at the corner of Richard and Ghurch Streets. Mr. Hodgson outlined the circumstances and terms under which the defendant had been occupying portions of the premises, referring to'the various alterations made from time to time, and the fact that the defendant had been for a time employed-, by the plaintiff company. Mr. M. O. Kidd gave evidence, and was cross-examin-ed. Mr. Bunkall for the defence contended that no notice had been given determining the tenancy, nor was there any evidence to. show who was the owner of the property for the time being, and that the rent was only seventeen days in arrear and that the proceedings could not be issued till the twenty-second day. His Worship refused to make an order for possession.
