Fuller to rooover a penalty of £50 in rospjot to five alleged breaohes of tho Dunedin Performing Musicians' award The broaches alleged wore that tho company employed F. H. Stokes, A. Neato E Mooro, D. Curline, and A. Webster as musicians between November 18, 1918 and December 14, 1918; and failed to pay 'them wages during this period, the premises clofi?d on account of til© influenza, epidcrruc.—Mr Lan ff , for the defendants said that cases similar to the present one in character had heen adjourned in Auckland for further evidence. The parties in this case had ejrrced to tho statement of facte, and no evidence would be offered Tho defendants admitted that no notice of tho termination of the engagement had bcoii given to the musicians, but they relied on the defence advanced in the caso against David Young, of the Excelsior Hotel, heard recently. This was that as tho premiss were closed bv an order made under tho Act, it was illegal for the employees to bn on the premises during the period named for the purpose of performing the duties for which ttey were engaged, consequently the emoloycrs could not be liable for wages Counsel also quoted judgments in shipping eases.—His Worship, in sdiouraintr the oas" sine_ die. said that he might po-sibly adopt a different course from that which ho had adopted in Young's cqso.
