ACTION FOE DAMAGES
AN UNUSUAL CASE.
(Peb United Press Association.) CHRISTCHURCH, July 23. ' An interesting action .wag commenced in the Supreme Court to-day, the parties being' Maude Eliza Felton and the Addington Ironi Rolling Mills. The plaintiff claimed £200' for damages to health and £500 damages for depreciation of property and injunc» tion to restrain the company from, a continuation of the injury and nuisance. fh° plaintiff resides near the mills, and alleged that the noises, smoke, and gasps emanating therefrom affceted her nerves, and had such an effect on her property that it was unsaleable. Prior to tho erection of the mills the locality had been a residential one. ''
The defence was, firstly, a general denial;', and, secondly, that too industry complaincd. of was one of public utility and was oarried on without negligence in a suitable locality, whero industries giving rise to noiso and smoke had long been carried on to the • benefit of tho public. The evidence had not been concluded when the court adjourned till to-morrow.
