RESIDENT MAGISTRATE'S COURT.
Friday, October 31st. (Before A. C. Strode, Esq, R.M.) ™7T? UNKEXNESS-~Jaraes Sampson and D. B McKenzie were fined 20s and costs, or in default 48 hours imprisonment.
. Stealing a Watch,-John Shofield was charged by Joiiu Dobson with having stolen his watch at the U nXed States Hotel. It appeared that a sort of general row had occurred, resulting in a fight, when the prosecutor handed over his watch to the accused. His VV orslnp stopped the case. Stealing a Hammer.—James Travers was charged by J ohn Dobson (the prosecutor in the former case) with having unlawfully taken away a hammer from tlie works at which he was employed under the prosecutor and his partner. The accused was discharged, there being no proof of felonious intention. Obtaining k Horse under False Pretences — 11ns was an adjourned case from the previous day for the evidence of Mr Strode, who, leaving the bench, which was now taken by J. H. Harris, Esq., deposed that the documents produced were the same as he arbitrated on some time back. John Mclndoe stated that the pony was in his possession. Graham had asked hira previously for the pony, but he (witness) had refused to give it up. He saw the accused twice on the morning the pony was taken, when he (the accused) said Mr Strode had made the award in hi.s favour for Ll3 2s, and he had come for the money and the pony. # Mr Harris at this stage stopped the case, saying that it ought to have been a civil aud not a criminal suit, as he was of opinion that Graham had taken the pony believing he had a right to do so. He advised the defendant to give up the pony, and to enter an action against Mclndoe in respect to its ownership. The civil cases were devoid of general interest.
