Whereas, by an Act of the Imperial Parliament, pa-sed in the Sesaiuu held iv the Twenty-fourth and '"'.venty-Sfth yeare of lit-r present Majesty's reign, intituled " Am Ac;t to empower the tioveruors of riie >-jVenil Au^tmliau Colonies to regulate the number of Urisseagorri to b• ctrrieii in vessels plying between Forts in those Colonies,' 1 it is amongst other things ouHCte.l that it shali be lawful for the trovernor of (j.ch of her Majesty's Colonies already or hereafter to }«■ tsUbll.-hed iv Aiistraiasia, by any Proclamation !u> be by him from time to time issued for th« purjj'J1* (which Proclamation shall take effect from the i.vmiu,: thereof, if no day bhall be namcl therein for j tie j-.urp'jac),to pre^ribe such rules as he shall think proper for determining the number cf psmsenders to be carried in an/1 passenger ship which shall proceed from any such Colony to any other of Her Majesty's possessions for the time benitf in Au»tral:isia, and for determining on what <!eck or deck* and subject to what reservations or conditions passengers may be carried, and also to i | prescribe such penalties for the infraction or uon- | observant of such Rules as to such Governor may :eem proper; and it is also enacted that from the time whea any such proclamation shall take effect, and so lonj? a* the same shall continue in force, the ! rules and enactments contained ia "The Passemrers I A<n, 1855," relating to the number of passengers to be carried in any passenger ship, and the deck o decka whereon thsv are to be carried, shall cease to apply to any vessel to which such pra^iwttion shall be applicable, save only as to the recovery and application of any penalty for any offence committed aptiusr the said Act before such proclamation shall take effect:
Now, therefore, I, Sir Georjra Grey, th« Governor of New Zealand, in exercise of the power verted ia me by the above recited Act, do issue this my proclamation, to take etfeet from the 16th day of June, one thousand ei^ht humlre-J and sixty-two, and I do hereby prescribe the rule 3 hereinafter set forth for determining the number of passengers who may be carried in any passenger ship which shall prf»eeed from the Gdoiiy of New Zealand to any other of Her t Majesty's possessions for the time being in Australasia, and on what deck or decks and under what reservations or conditions passengers may be carried, and the j>eualtie.s for the infraction or non-observance ot such rules, that in to hay :— A.—Sailing Yessilb. 1. No ship propelled by sails only shall carry a neater number of persons (including every individual on board) than ia the proportion of one statute adult to every two tons of her registered tonnage. 2. No ship shall carry under the poop or in the ronnd-honso or deck-house or on the upper passengerdeck & greater number of passengers thau in the proportion of one statute adult to every twelve clear superficial feet of deck alloted to their use.
3. No ship shall carryou her lower passenger-deck a. greater number of passengers than in the proportion of one stilt utea'ult to every Sfteea clear superficial feet of deck aiJoted to their use,provkJed, neverthele*?, that if the height between lower passen-ger-deck and the deck immediately above it shall be less tlian seven feet, or if the apertures (exelnsive of si le witt'.es) through which light sx>>\ air shall be admitted together to the lower patM-nger-deck, shall be less in size thau in the proportion of three square feet to every one hundred superficial feet of the lower n&si*!nKer deck, no greater number of passengers shall be carried on such deck than in the proportion of one statute adult to every twenty-live "clear superficial ! feet thereof.
4. No ship, whatever be her tonnajre or superficial ipace of passenser-deeks, shall carry a greater number of passengers on the whole than in the proportion of one statute adult to every five superficial feet clear lor exercise on the upper deck or poop (it secured, and fitted on the top with a railingor guard, to the satisfaction of the Emigrant Ollieera tthe port of clearance,) on any round-house or deck-house
5. In the measurement of the passenger-decks, poop, round-house, or deck-house, the space Tor the hospital and that occupied by such portion of the personal luggage of tht passengers a« the Emigration Officer may permit to be carried there, snail be included. B.—STEAMEXB. j The number of pas«engers who may be carried on j board of any vessel propelled by steam power shall be i ascertained anu determined in manner following, [ viz:—
1. Measure in cubic feet the clear space alloted to fore-cabin passengers between decks, and divide the cubic contents by 7—
2. Count the number of sleeping berths exclusively provided for the accoraodation of fore-cabin passengers, and ad^ to it the number obtained as above.
3. The totil number thus obtained is the total number of tore-eabiu passengers *vho may be carried. 4. Proceed in the same manner with the space al -)ted to after-cabin passenger?. The results of the said computations shall determine the number of fore-cabin and after-cabin passengers respectively who may be carried on board of a vessel propelled by steam power.and all passengers on board thereof shall be included in one or other of the said denominations. j PENALTIES. I If there shall jon board of any ship or Yesse! at I or after the time :.f clearance a greater number either of persons or passengers (except by births at sea) than in th* proportions respectively hereinbefore mentioned, the master of nicli ship or vessel shall be liable to a penalty not exceeding five pounds nor less than one pound sterling for each person or passenger constituting such excess.
