The decision in this case was given on the assembling of the Court. His Honor said that he had come to the decision that the flour had been sold by smnpic, and that there was, therefore, an implied warranty that the bulk corresponded with the sample which did not appear to have been the case. At the same time it did not appear that defendants had been nw.ire of this at the time *H che owners of the flour had not informed them of .t. They would therefore be enabled to recover from them. He would give judgment for the plaintiff for the sum of £74 ss. and costs.

The Court was then adjourned until the 4th March ucxt.
