IMPORTANT TO ROAD BOARDS.

Christchtjrch, January 24. A case of considerable interest to Road Boards was heard yesterday before Mr. Justice Johnston, on appeal in banco. Some time ago, the Oust Road Board cut a ditch over a formed and unformed road in the district. Over the formed part they placed a culvert, neglecting to fill up that portion of the ditch crossing the unformed part. A man who was driving cattle along the road went off the formed part and sustained injuries through his horse falling into the ditch. He brought an action in the lower Court for damages, and obtained a verdict. The Board then appealed to the Supreme Court, and yesterday the Judge held that, as the public had a right to use the whole 66 feet of road, the Board had been guilty of negligence in not filling up the ditch on the unformed part of the road, and dismissed the appeal with costs.
