John Hosty was charged with getting on the train while in motion. James D. .Clifford, sworn, said he was a guard on the express between Oamaru and Dunedin. On the 25th ult., when the train was opposite Mr. Maude's auction rooms, the accused jumped on the train. He ran through the carriages, and found Hosty, who was druaflf 1 He tf old him he would- have_ta Hosty answered that he TSbt did nßfc know he was doing throng. 'X; Mr. O'Meagher, who appearelfcfor the defence, argued that the accusect, who was employed on the ballast train and was in the habit of jumping on and off such engines, did not wilfully commit the offence with which he was charged. His Worship said- that no person was justified in getting on the train while in motion, but as the by-law was not in the Act he would be obliged to dismiss the case on that ground.
