J. K. CLEMF.NT V. S. M. SMITH. An application was made by the p for a new trial on the following grounds 1. That the Judge misdirected theJt the question of the plaintiff's right to da 2. That the verdict was against tbei of evidence. - 3. That the case made by the defew the former trial was a fictitious one,W up by numerous gross perjuries. The plaintiff called attention to the! fest perjuries committed by the defa as shown by plaintiff's and the Judge' of evidence, and strongly exclaimed« such a crime in a court of justice beinj) by without rebuke. His Honor refused to grant a neffC the ground of lapse of time, when? said he would not allow the matter' without further endeavours to seem*? The Court then adjourned sine die.
