According to the : police "officers, as they were about to take Bagby away, his brother enjoined him to, "keep his , mouth shut until, he had .sobered up." - "' Eight , witnesses' swore positively on behalf, of the defence that . they had seen Bagby at the tjme he was said to have committed the offence, but they had observed nothing) untoward m thedemeanorvof either .Bagby or, the girl as they returned to the dance hall. , - Judge Ostler said he was sorry the jury had been unable to agree. Bagby' was released on bail of £.1000 and two sureties totalling a similar arriount. • - '"
