CLAIM FOR WAGES
Mr F. V. Frazer, S.M., heard a civil action yesterday, in which William Frederick Moran, for whom Mr C. B. O’Donnell appeared, claimed the sum of JH wages from tho Rialto Company, Ltd. The evidence given for the plaintiff was to the effect that he was employed at the company’s factory during'the day at a weekly wage of A 3 Bs, and as a waiter at the Rialto at night at a weekly wago of £2. He gave up his position as a waiter, but intended to continue his day employment. The company, however, held that ho had left thedr employment altogether, on the ground that the night and day employment, as far as they wore concerned, was one. This, it was submitted, was not tho case, but that tho positions were separate. The defendants counter-claimed for X 3 8s in lieu of notice, but were nonsuited. Judgment was given for tho plaintiff for the amount claimed, with costs.
Mr P. W. Jackson appeared for tho defendants.
