A case removed from the Supreme Court came before the Full Court yesterday. It was originally heard m the Warden’s Court at Westport, The plaintiff respondent was John Watterson, of Ngakawau, coal miner, and the defendant appellants the WestportSfcockton Coal Company, Ltd. Both courts had awarded the plaintiff ±:3(XJ in connection with an accident wmon occurred to him in September, laid, while in the employ of tho company. He was acting as a brakesman on a tram of trucks going to the coal face, when ho was met by another train. While putting back towards a ■’layby,” the brake truck on which the plaintiff was riding became derailed and fell upon him, causing injuries, iCuluding a fractured leg and rib. The company denied liab.lity to pay damages apart from the Workers’ Compensation Act, and represented that weekly payments had been made to the respondent by the New Zealand Insurance Company. Messrs M. Hannan and A. C. Cottrell (Westport) appeared for the appellant company and M' P. J- O’Regan for the respondent. The Bench comprised the Chief Justice (Sir Robert Stout), Mr Justice Cooper, and Mr Justice Hosking. After argument the court reserved judgment.
