PEEFECT ALIBI PROVED IN ICUB- ’ ©EE CASE. LONDON, January 12. By order of Grown conned. Charles Warner has been released from Dunnes Prison, where since Wednesday. November 27th, he had been in custody in connection with the murder of Kite Jean Milne, at Eimgrove, Broughty Ferry. There is the uncertainty as to the date of Miss Milne's death. The testimony of the principal witnesses for the Crown supports the theory that the murder was committed on tire night of the 15th or morning of October 16th, but there axe at least three witnesses who testify to having teen Wifa Milne on the following W One of these is Alexander Tronp. • church officer. Broughty Ferry, who declares that on October 21st, while collecting subscriptions for the Broughty Ferry Benevolent Trust he called at Elm grove and saw Mias Milne at one of the upstairs windows of the house. He rang the door hell twins and got no reply, but he was not altogether surprised, and an hour or two later he returned to Blmgieve in the hope of getting an interview with her. On. this occasion, however, there was no sign of anyone about t the house. What struck him os peculiar was that on. the first occasion the cover of the lock of ..the front door was down, and that when lie returned it was UP, as if scaneone had either opened or locked the door from the outside. The substance of this evidence is supported by two gentlemen, who affirm that they also saw MiasMihm in Dundee, one on October 21st and the other on the following day. But apart from the acknowledged weakness of the evidence for the Crown, in this respect it is understood that Warner's defence ir a particularly strong one. At the outset be undertook to prove an alibi, and it is believed that the evidence in this connection went to prove a. perfect alibi. Warner was in a position to gibs detailed information regarding his various move* ments during a considerable period, extending beyond, but fully covering the time from October 15th to 22nd. and careful inquiry, it is stated, has gone to substantiate ins statement in every par ticular. . . The Dundee Procurator-Fiscal received a telegram stating that the precognitions in connection with the Illmgrovo murder had been fully considered .by the Crown counsel, and it had been decided that the evidence was insufficient. The release of Charles Warner, tne suspect, was accordingly ordered. After being released On the charge oi murder, Warner was arrested on th* charge of stealing an overcoat, and handed over to the London authorities..
