MOTION TO QUASH A BY-LAW His Honor Mr Justice Chapman heard legal argument on {Saturday concerning a motion to quash a city bylaw regarding hoardings. The action was brought under the By-laws Act, 1910, Lawrence Goodwin Porter, an advertising agent, moving to have'section 79 of the Wellington City by-iawt quashed. This by-law imposes a license fee oitehoardings used for posting hills, and it was contended the licensee fee was grossly unreasonable and excessive. Mr H. F. Von Haast appeared in support of the motion,’and Mr J. O’Shea opposed it. The point at issue was whether the fee should be merely a registration fee or whether the council had power to rqptrict hoardings’by imposing a fee ia the nature of a tax. His Honor reserved decision.
