THURSDAY, FEBRUARY 13. (Before Mr W. G. Riddell, S.M.) Frederick Olsen was remanded until February 17th on a charge of stealing a bicycle belonging to Eouis Dock, whom he is also alleged to have assaulted, and used obscene language to. Bail was allowed, self in £2O, or two sureties of £lO each. For insobriety, Edward Mohan was lined 40s, William Grant 20s, and Dillon Minogue 10s. CIVIL MATTERS. (Before Mi W. G. Riddell, S.M.) ALLEGED DAMAGE TO PROPERTY. A claim for £IOO for damage alleged to have been caused to the plaintiff's property, was made by Thomas William Robson, railway employee, of Ngaio, against Henry Bardsley, builder, also oi Ngaio. Mr M. F. Luckie represented the plaintiff, and Mr O. Beere the defendant. Plaintiff is the owner of a piece of land fronting Imlay crescent, Ngaio, and defendant is said to own, or have owned, a property opposite to plaintiff’s on the other side of the street. In his statement of claim plaintiff set out that in or about July last, defendant, in the course of certain excavation works being then carried out by him, caused the spoil and earth dug out to be banked up against the fence fronting his (plaintiff’s) property. The result was that the water-table of the street was obstructed with spoil so as to entirely prevent the proper drainage of storm-water along the watertable. As a consequence, the stormwater during the heavy rains that fell in the months of July and August flooded right across the road and broke down his (defendant’s) fences, scattered and poured the spoil over the greater portion of his property, uprooted shrubs and flowers, and destroyed his garden, and otherwise did great damage to his property. After the evidence for the plaintiff had been partially heard, the case was adjourned until Tuesday next. UNDEFENDED CASES.
